DON'T GET DETERRED BY SUPREME COURT'S VERDICT. WE WILL WIN!

Let us slap back those who are saying that being a Gay is a crime and a sin and against the so called Indian Culture. We have proofs and let us make sense to the dumb-headed people who vouched for it.

 

1. Being a Gay is a Genetic trait:

 

        I can quote hundreds of foreign research articles which have proved to considerable extent that being a Gay is totally Genetic. But our people will say that those studies are biased. So let me quote the words of a contemporary top - notch Indian Psychiatrist M. S. Bhatia who declared and I quote, "Gay nature has a strong Genetic basis." (unquote)

 

      Some people senselessly claim that there is no genetic link to this behavior. But have any of them proven it scientifically? No. Research on Gay behavior is a growing field but yet has made remarkable strides in the past decade. Though we are not able to fully prove that (come on. No genetic behavior can be fully proven) we are able to present some well researched facts linking Gay nature and Genes. A thing as complicated as a sexual orientation involves the networking of a variety of Genes and could not be convincingly presented even with regard to straight sex. Most of the studies about Gay orientation have been largely biased and are never given a legal standing anywhere. But the favor is more towards the influence of genes as it is time and again proved through identical twin studies. Haters please learn to talk with some scientific proof.

 

A Judge of any court may be a master of law but need not necessarily have a sound medical knowledge to decide on such things. If the Judges in India want to pass an order criminalizing Gay sex thinking that they have the necessary psychiatric and medical knowledge then in future let them also decide the rape cases by themselves without sending the candidate for medical examination. A legal opinion on such matters should be backed by a well studied Medical opinion. 

 

2. Gays are a part of Indian culture and almost in all civilizations of the world:

 

To all the Moral Police out there: If you wanna say that Gays are against the Indian culture then first go and demolish the homosexual statues at Khajuraho (MP) and Sun Temple at Konark. Further please tear away the chapter on Auparistaka (homosexual intercourse) from the Kamasutra and if possible burn it.  

 

Show any one culture before the advent of religious groups which condemned such practice. The opposition to homosexuality arose only in few religions which was then imposed to the cultures that were previously tolerant. 

 

3. Homosexuality is not a disease:

 

American Psychiatric Association in its DSM - IV (TR) classification have removed homosexuality from Psychiatric disease list. Further the World Health Organization in its ICD - 10 Classification (which is also used in India for classification of Mental Illness) have also removed homosexuality from its list. Now if such premier Psychiatric institutions with thousands of references and research studies have decided that Homosexuality is a normal behavior then under what basis the law makers of India still hold on to this age old misconception? If you are still in a colonial hangover and clinging on to the 145 years old British (actually Christian belief) act which vaguely criminalizes sexual acts on the basis of Biblical knowledge then God help us.

 

4. Religion has no right to decide on this matter:

 

Hindu religion have always been tolerant towards the homosexual practices. At least in Christianity there are seven references in the Bible condemning homosexuality and three passages which directly mention the word Homosexuality and condemn it as a deadly sin. Similarly Islam also condemns Gay sex in Qur'an and declared it to be sin which should be awarded death penalty. But is there a single reference in any of the Hindu literature which openly mentions about condemning homosexual. If the majority religion of our country (Hinduism) has no clear reference about homosexuals then is it o.k. for our lawmakers to take reference from Bible which is the basis of Indian constitution given by British?

 

Further if religious texts could be taken as the basis for the law of the land then there is no point in calling India as a secular country.

 

5. Order of nature and homosexuality:

 

What is the definition for order of nature in Indian Constitution? Is it clear? A consensual sex between a man and a woman which results or does not result in childbirth is considered to be the order of nature in India. On what basis it is defined? Why is prostitution allowed in certain pockets of the country? How do the Transgenders were given an approval by the Govt. and is now included in most of the Govt. application forms as a third sex? Transgenders were also once considered by the lawmakers to be against the order of nature. Now after citing the historical and psychological aspects and after a long fight by NGOs it is now being accepted and also recognized. Our Constitution is flexible and is open for any amount of amendments. You are not Gods to determine the order of nature. As the entire world knows the Indian Constitution is the lengthiest one with lots of vague definitions. Till date are you able to create a separate provision for Pedophile offenders? Is there a clear and stringent law to punish Rape? When the important issues like these are lying unseen is it really that important for the judges to interpret order of nature for criminalizing homosexuality.

 

NO ONE CAN TAKE AWAY OUR RIGHT TO LIVE OUR LIFE IN OUR OWN TERMS AND WITH FULL DIGNITY. THE COMING YEAR WILL BE AN YEAR OF OPEN CELEBRATION FOR MANY GAYS WHO ARE NOW COMING OUT OF THEIR CLOSET AND STARTED THEIR OPEN DECLARATIONS TO THEIR FAMILY AND FRIENDS. THIS IS A VERY BIG OPPORTUNITY FOR US TO SCALE GREAT HEIGHTS. IF DELHI HIGH COURT VERDICT IS AN EYE OPENER THEN OUR FIGHT AGAINST THE SUPREME COURT'S VERDICT WILL BE THE OPENING OF A NEW ERA IN INDIA.

  2. i need a like button for all the posts and comments here :P.. Awesome writing John !! Very clearly stated ! But I have a question for you ! How does/does gender identity influence sexual orientation ? or vice versa ? Can you please write something on this ?

    @ kannagi and vicky na: see, all this discrimination based on sexual orientation is directly a result of the discriminations based on gender. as for as male homosexuality is concerned ( assuming you as a lesbian ! ), the common people understood that "being sexually attracted to men = being effeminate" This is very much stereotyped ( as the vast majority of gay men seems to be effeminate at least in the slightest possible way ! ). So in a male chauvinistic society like us, being feminine in any form is not tolerated.

    When female is given enough rights in the ruling arena, things would automatically, dramatically change ! When feminine rules, it embraces, every variation of sexual orientation and gender identity ! We will have a different kind of world to live in !

    Only the rudimentary masculine mind thinks there are only two possibilities of manifestation of nature. ( but what they mean is out of the two, the weaker should be made as dumb and deaf, not allowing them to opening their mouth ). so lets also work towards the rise of feminism, and sit back and watch all the desired things happening automatically !

    1. Thanks. It's a good question. Gender identity involves two factors. Physically how the person is and psychologically how he feels. Both these things should be similar. Bodily he should be a man and his mind also should feel like a man. If both are opposite then it is called gender identity disorder. Yes. It influences the orientation and opposite sex behavior too.

  3. @rockingraj star: I agree with your view about the prejudice people have. But there was a previous post (20 November 2013) from John Paul about this. Working together for equal rights should put us in a place where we are supposed to voice against any atrocities that may attack the suppressed minorities. This does not stop with LGBT rights, feminism, casteism etc it keeps expanding until there is equality in every sphere.
